Seek to rent an Aircraft (the “Aircraft”) from Light Sport Aviation LLC (henceforth “LSA LLC”). In order for LSA LLC to give me care, custody, and control of it, I agree to abide by the following rules. I understand that these rules may be more restrictive than applicable federal, state, or local statutes, ordinances, rules and/or regulations.
1. I understand that I will be billed based on Hobbs time elapsed from engine start to engine stop in one-tenth of an hour increments, based on hourly rates set by LSA LLC for the aircraft being rented. For instance, if I fly for 1 hour and 30 minutes (1.5 hours) at a rate of $145/hr, I will owe $217.50.
2. I agree to comply with all federal, state, and local laws, ordinances, and Federal Aviation (FAA) regulations.
3. I will inspect and conduct a thorough and complete preflight check of the Aircraft, and its equipment and accessories before each flight, in accordance with:
a. The applicable Aircraft checklist provided by LSA LLC, or an Aircraft checklist approved by ;
b. The respective Pilot’s Operating Handbook or equivalent for the Aircraft being rented; and
c. The applicable Federal Aviation Regulations.
4. I will not operate the Aircraft unless I am satisfied with its airworthiness and the proper function of all required equipment and accessories.
5. I agree to return the Aircraft at the scheduled time, weather-permitting, and will return it in the same condition that I received it, normal wear-and-tear considered.
a. If I encounter any delays to my scheduled flight time, I will notify the flight school as soon as practicable.
6. I understand that I am obligated to return the aircraft in a clean, neat state, and remove any accumulated waste prior to checking in the flight. Wiping of windshield and leading edges post flight is a must. LSA LLC provides wipes, chemicals, and vacuum cleaner for your convenience.
a. I understand that failure to meet this obligation may result in a fee, as noted under the “Fees” section of this agreement.
7. I agree to use the Aircraft solely for the purpose of personal, recreational flying, and will not use the Aircraft for any type of instruction, for hire, or any other commercial use or activity.
8. I will not make any flight for which I have not met FAA currency requirements, and that I must:
a. Hold a current and valid FAA medical certificate (if holder of Private Pilot License -PPL), or valid driver’s license (if holder of Sport Pilot License- SPL);
b. Be properly certificated in the category and class of Aircraft being rented;
c. Maintain a current flight review; and
d. Meet the recent experience requirements set forth in 14 CFR § 61.57.
9. I am aware that an aircraft checkout with a LSA LLC Flight Instructor is required prior to any rental.
a. I am aware that a minimum of one aircraft checkout with an LSA LLC Flight Instructor is required prior to any rental. Additional checkouts may be required based on the feedback and discretion of the Flight Instructor.
b. A rental checkout will consist of a review of takeoffs and landings, flight at minimum controllable airspeeds, stalls and recoveries, aircraft systems, and appropriate operating speeds.
10. I will not make any off-airport or water landings, except in the event of an emergency.
11. I agree to complete all preflight action required under 14 CFR § 91.103 prior to flight.
12. I agree to discontinue the flight if, while conducting flight under VFR, the ceilings and visibility are less than the minimums required for Basic VFR flight.
13. As a pilot in command (PIC) I will have the following documents in my possession during each flight:
a. A pilot certificate with appropriate ratings;
b. A current medical certificate (if holder of PPL), or valid driver’s license (if holder of SPL);
c. A government-issued photo ID; and
d. If required, applicable logbook endorsements.
14. I will not operate the Aircraft:
a. Within 8 hours of drinking an alcoholic beverage;
b. While bearing a blood alcohol content 0.04% or greater; and/or
c. If using any type of prescription or non-prescription drug that may affect my flying.
15. Except for the purpose of takeoff and landing, I will not operate the Aircraft at an altitude below that which would permit a safe landing without hazard to persons or property on the ground.
16. I will not practice or intentionally conduct a spin in the absence of a flight instructor.
17. I will land only on public-use, paved runways. Landing on sod or grass runways will be considered on a case-by-case basis.
18. I will ensure that the Aircraft has sufficient fuel onboard to arrive at my destination with at least one-hour reserve, and will discontinue the flight if my reserves are less than the minimum.
19. I agree to report any accident, incident, emergency, and/or precautionary procedure to:
a. The FAA, as required; and
b. LSA LLC.
20. I agree to, in the event of a precautionary or emergency landing, notify LSA LLC immediately after landing, and understand that I am solely responsible for the safety and security of the Aircraft until relieved by a member of LSA LLC’s staff.
21. I agree that LSA LLC will not be liable or responsible for any loss or damages suffered to me due to aircraft availability, malfunction, or my failure to arrive at my destination on a timely basis. I agree that LSA LLC makes no implied or express warranties concerning this rental.
22. I agree to pay for all posted charges including any landing fees that may be paid by LSA LLC on my behalf as a result of any of my flights.
23. I agree to report all aircraft discrepancies and/or malfunctions immediately, for both local and distant flights. Once a discrepancy has been reported, maintenance staff must inspect the discrepancy or malfunction to resume flight locally. In regard to a distant flight, I will notify LSA LLC of the problem, and LSA LLC staff will work together to decide a course of action. LSA LLC has the final authority to make the decision on how to best handle distant discrepancies.
24. Overnight flights must be approved on a case-by-case basis, with minimum flight time set by an authorized member of LSA LLC’s staff.
a. Regardless of the actual time flown, there will be a minimum charge for 3 flight hours for any overnight flight rental. This charge is applied to ensure availability and proper scheduling of the aircraft for other students and renters
b. Mechanical Issues Away From Base: In the event of mechanical issues encountered at an airport other than the home base due to the aircraft's condition, LSA LLC will provide or arrange for transportation of the Renter back to Las Vegas. This provision applies only if the mechanical issue is directly attributable to the aircraft's condition and not due to renter's misuse or negligence.
c. Weather-Related Deviations: The Renter is responsible for all charges incurred due to deviations necessitated by weather conditions. This includes, but is not limited to, landing fees, additional rental time, and any personal accommodations required as a result of weather-related deviations. The Renter must exercise prudent judgment in flight planning and weather assessment to minimize such occurrences.
d. Landing Restrictions: The Renter agrees to land only at FAA-approved airports. Backcountry strips, off-field landings, or any landing areas not officially recognized and approved by the FAA are strictly prohibited. This restriction is in place to ensure safety, compliance with aviation regulations, and protection of the Aircraft from potential damage.
e. Pre-Approval of Flight Plans: Prior to any cross-country flight, the Renter must submit a detailed flight plan to LSA LLC for pre-approval. This flight plan must include, but is not limited to, proposed routes, estimated times of departure and arrival, and planned stops. LSA LLC reserves the right to request modifications to the flight plan or deny approval based on safety, operational concerns, or aircraft availability.
f.Cancellation Charges: If a cancellation is made within the 36-hour window preceding the scheduled flight time, and the reason for cancellation is not related to weather or maintenance issues deemed valid by LSA LLC, the Renter will be charged for a minimum of two (2) flight hours (Hobbs time
25. If the renter chooses to use 100LL aviation gasoline in the rented aircraft, it is mandatory to add the Decalin additive. This is to ensure the optimal performance and longevity of the aircraft's engine. Failure to adhere to this condition may result in penalties as stipulated elsewhere in this agreement.
26. The rental rate for the aircraft is provided on a "wet" basis, which means it includes the cost of fuel. The flight school assumes a standard fuel cost of $5.00 per gallon for reimbursement purposes.
a. Should the renter purchase fuel at a rate higher than the assumed school cost, the school will reimburse the difference. For example, if a student purchases 10 gallons of 100LL aviation gasoline at $7.00 per gallon, the school will reimburse the student $5.00 per gallon, equating to a total of $50.00 for that transaction.
27. Cancellations within 24 hours of the scheduled flight may be charged a minimum of 1 hour of flight time.
a. Exceptions include illness, family emergencies, weather, or at instructor discretion.
28. All aircraft rentals are subject to meeting all company and insurance requirements set forth by LSA LLC.
A minimum of $25,000 Insurance Policy is required for each of the following:
a. Non-owned Aircraft Liability - Single Limit Bodily Injury and Property Damage
b. Liability Including Passengers
c. Liability for Damage to Non-Owned Aircraft
29. I understand LSA LLC reserves the right to cancel or modify Aircraft reservations for any reason at any time.
30. I have read and understand actions that can lead to me being charged, and agree to pay any and all fees added to my account as a result of a violation of this agreement.
Fees
1. Cancellations within 24 hours of a scheduled flight.
a. A $100 fee will be charged to your account if you cancel within 24 hours with the exception of weather, family emergency, unexpected illness, or at instructor discretion.
b. Should a renter cancel within this 24-hour period on three separate occasions, the renter will be held responsible for paying the entire cost of the reserved flight time for the aircraft, irrespective of the reason for cancellation.
2. Trash left in the Aircraft.
a. A fee of $25 will be added to your account if it is discovered that trash has been left in the Aircraft after the scheduled rental period has lapsed.
3. Cleaning Fee - Contamination
a. A fee of $100 will be charged to clean the airplane of any vomit.
